Wakatobi - 2025 - Travel Services Agreement, Terms & Conditions
DEPOSITS: All requests for bookings must be made through Dive Addicts, Inc. representatives. NO reservations are confirmed until proper payment is received according to the Terms and Conditions herein. Dive Addicts, Inc. requires a minimum of 5.00% per person to secure a reservation, however, some packages require an additional amount which will be quoted at the time of booking. Any payment of a deposit constitutes a full acceptance of Terms and Conditions specified herein. All deposits are NON-REFUNDABLE. Dive Addicts, Inc. shall have no obligation to provide confirmation of any reservation until the deposit is actually received. Any travel packages which include airfare are subject to applicable airline rules and policies.
PAYMENT TERMS: All deposits and subsequent payments must be paid in U.S. currency and checks must be drawn on U.S. banks made payable solely to Dive Addicts. The balance of any payments must be made to Dive Addicts subject to the individual trip payment schedule attached to this document specifically for this trip (Trip Payment Schedule). If payment and/or deposit are made with a credit card and/or Debit Card, purchaser fully authorize these charges for the deposit and/or any payments made.
CANCELLATION AND REFUND POLICY: All deposits and future payments are NON-REFUNDABLE. Failure by purchaser to provide payment to Dive Addicts according to Trip Payment Schedule constitutes breach of this agreement and will result in purchaser’s reservation being cancelled. Cancellation of the reservation due to non-payment does NOT however release purchaser of the full financial obligation for the contracted reservation. The purchase of trip cancellation and interruption protection along with accident and baggage insurance is strongly recommended by Dive Addicts.
PROOF OF CITIZENSHIP/VISA: Citizenship and VISA requirements vary according to destination. All participants are responsible for determining and obtaining proper documentation. To avoid denied entry and return, all Passports must be valid for a minimum of 6 months after the return travel date. Dive Addicts is in no way responsible for obtaining and providing this documentation and therefore, no refunds will be granted for denied entry caused by failure to carry proof of citizenship or the appropriate VISA and/or Passport.
ACKNOWLEDGEMENTS: In consideration of services provided and other good and valuable consideration, the undersigned hereby acknowledges and affirms that Dive Addicts, its agents, servants and employees, hereinafter “DA” are acting solely in its capacity as an agent in arranging and securing certain transportation, hotel, travel packages and other associated travel services for the undersigned. The undersigned further acknowledges and affirms that he/she understands that it is his/her sole responsibility to obtain any required travel documents (Passport, VISAS) and/or immunizations to insure proper and safe transit and travel to certain destinations. Purchaser/customer further acknowledges and affirms that due to the present state of global and political unrest and terrorism, DA does not, and can not, attest to, warrant to, guarantee the safety of the undersigned during travel or transit to any destination or country, especially those which have, or are presently the subject of a United States Department of State’s Travel Warning. The undersigned further acknowledges that personal and property safety while in transit and during travel is his/her sole responsibility and not that of DA, and that DA is not liable to undersigned, or the undersigned’s heirs and/or beneficiaries, for any entity’s failure to perform or provide service; theft, loss or damage to the undersigned’s property; or inconvenience, emotional or physical distress, illness, injury or death, or any weather condition, pilferage, mechanical failure, cancellation, delay, rerouting, strike, coup, political unrest, terrorism, conflict, war or acts of GOD. The undersigned acknowledges and understands that in the event it becomes necessary to alter arrangements or itineraries, DA may do so at no expense to DA and all additional fees are to be borne by the purchaser/customer. DA reserves the right to withdraw or cancel any travel, or travel packages at any time and to decline, accept or retain business from any purchaser/customer.
ASSUMPTION OF RISKS: The undersigned hereby acknowledges that if he/she engages in group tours, canoeing, kayaking, biking, snorkeling, scuba diving, sky diving, bungee jumping and like activities or borrows, rents or purchases equipment for such activities, including but not limited to automobiles, bikes and motorcycles, canoes, kayaks, parachutes, bungee ropes and snorkeling/scuba gear do so at their own risk and acknowledge by signing below that they possess the requisite physical and mental health and training/license/certification to engage in such activity.
WAIVER AND RELEASE OF LIABILITY: In the absence of gross negligence, in consideration of services rendered and other valuable consideration, the undersigned, his/her heirs, beneficiaries, executor, administrator, employers, agents, representatives, insures and attorneys, to the fullest extent allowed by law do hereby release and discharge DA, its owners, officers, shareholders, employees, and agents from any and all claims and causes of action for personal property damage or loss, personal medical or hospital costs (including air, land or sea evacuation), personal illness or bodily injury, including pain and suffering, emotional distress or death, personal economic impairment, and other consequential losses that may arise during and/or as a result of the undersigned’s of any travel, transit or participation in of any activity associated with such travel or transit.
SEVERABILITY: It is understood and agreed that, if any provision of the Agreement or the application thereof is held invalid, the invalidity shall not affect other provisions or applications of the Agreement which can be given effect without the invalid provisions or applications. To this end, the provisions of the Release of Liability are declared severable.
CONSTRUCTION AND APPLICABLE LAW: The language of all parts of this Agreement shall in all cases be construed as a whole, according to its fair meaning, and not strictly for or against any party. This document shall be interpreted pursuant to the laws of the state of Utah and that all disputes or disagreements shall be litigated solely in a Utah court of law.

Dive Medical Insurance is Recommended - Medical evacuation from remote locations such as Wakatobi and treatment can be very expensive. Dive Addicts recommends acquiring medical diving insurance from a recognized and reputable insurance carrier such as DAN or DiveAssure. List "N/A" in these fields if you choose not to have Dive Medical Insurance.

over the age of majority and/or 21 years, and have been or will be trained in safe diving practices before any diving activities. I affirm that I am in good mental and physical condition for diving. The purpose of my diving activities is strictly recreational.
For the purposes of this liability agreement, the term “Tour Operator” shall include the following entities: DIVE ADDICTS INC. also known and doing business as DIVE ADDICTS, as well as any unnamed principals, employees, agents or servants of the Tour Operator.
In consideration for engaging in travel and diving activities at the prices agreed upon between myself and the Tour Operator and in order to induce the Tour Operator to accept me as their client, as well as other good and valuable consideration, I hereby expressly agree to completely assume all risks set forth in this agreement, and hereby expressly release the Tour Operator from any and all liability that may result from the same. I further agree to hold the Tour Operator harmless from any claims or liability for any personal services, loss of income or other claims that may result due to my engaging in this trip, whether said claims are brought directly by me or indirectly by any other party.
It is also understood that the Tour Operator does not, by acceptance of me as their client, assume any responsibility or liability for my safety, freedom from accident, injury or death, or any losses or damages to my property.
I acknowledge and understand that the risks I am assuming, and from which I am releasing the Tour Operator, include each and every item set forth in the following para- graphs numbered “1” through “16.” Inclusive:
